California Vehicle Code Section 2315
“(a) It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.
(b) It is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.”
Driving under the influence (DUI) cases are serious and, often times, complex cases. In California, a DUI is actually two separate offenses. The “a” count applies to drug DUI’s and alcohol DUI’s where the driver is too impaired by alcohol to safely operate a motor vehicle, but their BAC is below a 0.08%. The “b” count is applicable when a driver’s BAC is at, or above, 0.08%.
